Ministry of Commerce imposes anti-dumping duties on neoprene rubber

On May 10, 2005, the Ministry of Commerce of the People's Republic of China issued the 23rd bulletin of the year and decided to implement the final anti-dumping measures on imported chloroprene rubber originating in Japan, the United States, and the European Union.

On June 8, 2009, Chongqing Changshou Chemical Industry Co., Ltd. and Shanxi Synthetic Rubber Group Co., Ltd. filed an application to the Ministry of Commerce for the review of dumping and dumping margins for anti-dumping measures applicable to imported chloroprene rubber originating in Japan. During the implementation of the original measures, the dumping margins of neoprene rubber exported by Japanese manufacturers and exporters to China increased, exceeding the anti-dumping tax rate fixed by the final ruling, requesting that the dumping margins of Japanese manufacturers and exporters be recalculated and the anti-dumping be adjusted accordingly. Tax rate.

After examination by the Ministry of Commerce, the application submitted preliminary evidence of an increase in the dumping margin. On August 28, 2009, the Ministry of Commerce issued a public announcement and decided to conduct an interim review of the anti-dumping measures applicable to imported chloroprene rubber originating in Japan.

The scope of the review investigation is the normal value, export price, and dumping margin of Japan's exported products under investigation. The product under investigation for the re-examination investigation is the same as the product under investigation in the original anti-dumping investigation, namely, neoprene rubber, also known as chloroprene (chloroprene) rubber, which was attributed to the "Import and Export Tariff of the People's Republic of China" Tariff No. of other primary shapes. Chloroprene (chloroprene) rubber, Chloroprene (chloroprene) rubber not listed. The English name of the product is Chloroprene Rubber (CR).

A total of three Japanese neoprene manufacturers responded and submitted questionnaires within the specified time. The Ministry of Commerce conducted a review of the dumping and dumping margins of the three Japanese companies, and proposed to the Customs Tariff Commission of the State Council amendments to anti-dumping duties based on the investigation results.

Pursuant to Article 50 of the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce’s “Interim Provisions for Interim Review of Dumping and Dumping Margin” and Article 37 of the Ministry of Commerce and the Customs Tariff Committee, the related matters are now announced as follows:

First, ruling

After investigation, the Ministry of Commerce ruled as follows:
(1) Dumping margin of DENKI KAGAKU KOGYO KABUSHIKI KAISHA: 9.9%;
(II) The dumping margin of Tosoh Corporation was: 10.2%;
(c) The dumping margin of Showa Denko Corporation (SHOWA DENKO KK) was: 20.8%;
(D) The dumping margin of other Japanese companies is: 43.9%.

Second, impose anti-dumping duties

Since August 28, 2010, anti-dumping duties have been levied on imported neoprene rubber originating in Japan's related companies according to the above-mentioned dumping margin.

Third, the method of imposing anti-dumping duties

As of August 28, 2010, importers should pay the corresponding anti-dumping duties to the Customs of the People's Republic of China when importing imported neoprene rubber originating in the aforementioned companies in Japan. The anti-dumping duty shall be calculated on the basis of the ad valored customs value of the duty-paid price. The formula is: anti-dumping tax amount = customs duty-paid price × anti-dumping tax rate. The value-added tax of the import link shall be calculated from the duty-paid price approved by the customs together with the duties and anti-dumping duties as the taxable price.

IV. Administrative Reconsideration and Administrative Litigation

According to Article 53 of the "Regulations of the People's Republic of China on Anti-dumping," if it is not satisfied with the decision of this review, it may apply for administrative reconsideration, and may also file a lawsuit in a people's court.

V. This announcement shall be implemented from August 28, 2010.
